PSDmate ("we", "us", "our") is a trading name of a sole trader operating from Bristol, England. Our address for service is 5 Brayford Square, London, E1 0SG, United Kingdom, and we can be reached at PSDmate@proton.me. By creating an account or using PSDmate you agree to these Terms. If you do not agree, do not use the service.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract. You may not use PSDmate if you are prohibited from doing so under applicable law.
2. Your Account
- You are responsible for all activity under your account.
- Keep credentials secure. Notify us immediately of unauthorised access.
- We may suspend or permanently terminate accounts that violate these Terms, abuse the service, or engage in fraudulent activity, at our sole discretion and without prior notice.
3. Intellectual Property — Your Content
- You retain all rights to artwork, PSD files, and other content you upload ("Your Content").
- By uploading, you grant us a limited, non-exclusive licence to process Your Content solely to provide the service.
- You are solely responsible for ensuring you hold all necessary rights, licences, and permissions for every piece of content you upload. We do not verify ownership.
- We expressly disclaim all liability for any intellectual property infringement arising from Your Content, including claims from third-party rights holders, Etsy, or any print-on-demand platform.
- If we receive a valid DMCA / copyright takedown notice related to Your Content, we may remove it and suspend your account without liability to you.
4. Intellectual Property — Our Platform
All software, UI, branding, and documentation comprising PSDmate is owned by us or our licensors. You may not copy, reverse-engineer, resell, or create derivative works from it.
5. AI-Generated Content
PSDmate offers AI image generation and AI-written listing copy via third-party providers — currently OpenRouter and Google (Gemini), plus any provider you supply your own API key for (OpenAI, Stability AI, Replicate, AIML API). The current list is always the one in our Privacy Policy. You acknowledge:
- AI output may inadvertently resemble third-party works. You are responsible for reviewing outputs before commercial use.
- We make no warranties about the originality, accuracy, or commercial suitability of AI-generated images.
- Some jurisdictions may not recognise copyright in AI-generated works. You assume all risk of commercial use.
- Your plan includes an allowance of AI images generated on our provider account. Once it is used, you may wait for the next billing period, upgrade, or connect your own API key and continue at your own cost — see section 6a.
6. Third-Party Services
PSDmate integrates with Etsy, Amazon S3, Supabase, Clerk, PrintShrimp, and other third parties. We are not responsible for the availability, policies, or actions of those services. Your use of Etsy must comply with Etsy's own Seller Policy. We are not liable if Etsy suspends or bans your shop, whether or not that results from content generated using PSDmate.
6a. Costs You Carry Yourself
Your plan covers your use of PSDmate, including the AI image allowance shown on your plan and the AI writing used for listing copy and subject detection. It does not cover anything you buy from anybody else.
- Your own tools. If you generate artwork in Midjourney, Photoshop, or any other service and bring it into PSDmate, that subscription is yours. We do not supply it, resell it, control its price, or refund it if its price changes or it stops working.
- Your own API keys. You may connect your own provider account instead of using your plan's allowance. Anything generated on your key is billed to you by that provider at their rates, does not count against your plan allowance, and is not reimbursed by us.
- Marketplace and payment fees. Etsy listing, transaction and payment processing fees are set by Etsy and charged to you.
- Printing and fulfilment. Costs charged by any print provider are between you and them.
Where your plan allowance runs out, you may either wait for the next billing period, move to a plan with a larger allowance, or connect your own API key and continue at your own expense.
7. Acceptable Use
You must not use PSDmate to:
- Infringe any intellectual property rights (including uploading artwork you do not have rights to)
- Generate, store, or distribute illegal, obscene, or harmful content
- Circumvent, scrape, or overload our infrastructure
- Resell or sublicence access to PSDmate without our written consent
- Violate any applicable law
Violation may result in immediate account termination without refund.
8. Billing & Refunds
- Subscriptions are billed in advance on a recurring basis.
- All payments are final. We do not offer refunds except where required by law.
- We may change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance.
- We reserve the right to modify, suspend, or discontinue any plan or feature at any time.
8a. EU/EEA Consumers — Right of Withdrawal
If you are a consumer resident in the EU/EEA, you have a statutory right to withdraw from your purchase within 14 days without giving a reason (Directive 2011/83/EU). To withdraw, email PSDmate@proton.me or use the contact form within that period.
Immediate access: Because PSDmate is digital content/services supplied immediately, by subscribing and starting to use the service you expressly request that performance begins during the withdrawal period and acknowledge that you lose the right of withdrawal once the service has been fully performed. To the extent the service is only partly performed when you withdraw, you may be charged a proportionate amount for what you have used. Nothing in these Terms removes mandatory consumer rights you have under the law of your country of residence.
8b. Cancellation, and What You Are Charged For
If you are using PSDmate for a business — which includes selling on Etsy or any other marketplace — the consumer cancellation rights in section 8a do not apply to you. You may cancel at any time from Settings → Billing. Cancellation stops the next renewal; the period you have already paid for runs to its end and is not refunded in whole or in part.
If you are a consumer, section 8a applies and nothing here removes it. Where you have asked us to begin immediately and you then withdraw, we deduct a proportionate amount for the service already supplied. That amount is measured by what the account has actually consumed — mockups rendered, AI images and listing copy generated, listings published, and the third-party costs we incurred on your behalf. Where an account has made substantial use of the service, that deduction can equal the full fee for the period.
We say this plainly because the costs are real and immediate: every render occupies our compute, and every AI generation is billed to us by the provider the moment you press the button. Those costs are not recoverable once incurred, and they are the reason a refund is proportionate to use rather than automatic.
9. Disclaimer of Warranties
The service is provided "as is" and "as available". We make no warranties, express or implied, including fitness for a particular purpose, non-infringement, or uninterrupted access. We do not warrant that generated mockups will meet your commercial requirements or Etsy's listing standards.
9a. No Earnings Guarantee
PSDmate is a tool for making mockups and listings. It is not a guarantee of sales, income, or business results, and we do not promise any.
- We make no representation that using PSDmate will earn you money, recover its own cost, or produce any particular number of sales, views or listings.
- Nothing on our website, in our emails, or in any example, screenshot or figure we publish is a projection or promise of what you will earn. Results shown are illustrative, not typical, and not a forecast.
- What you earn depends on your artwork, pricing, niche, marketing, competition, and Etsy's own ranking and policies — none of which we control.
- Whether a listing ranks, converts, or is permitted to remain live is Etsy's decision, not ours.
You are responsible for deciding whether a subscription is worth its cost to you, and for cancelling if it is not. If you are a consumer, this section does not affect your statutory rights, including those set out in section 8a.
10. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or lost sales, even if advised of the possibility.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from: (a) Your Content; (b) your use of the service; (c) your violation of these Terms; or (d) your infringement of any third-party rights.
12. Termination
We may terminate or suspend your account at any time for any reason. You may cancel at any time via account settings. On termination, your data may be deleted after 30 days.
13. Governing Law
These Terms are governed by the laws of England and Wales, and disputes are subject to the jurisdiction of the courts of England and Wales. If you are a consumer resident in the EU/EEA, this does not deprive you of the mandatory protections of the consumer-protection law of your country of residence, and you may bring proceedings in the courts of your home country.
14. Changes
We may update these Terms. We will notify you by email or in-app notice. Continued use after the effective date constitutes acceptance.
